FH UPNVJ Receives Visit from DPD Group at MPR Discusses the Discourse on the 5th Amendment to the 1945 Constitution of the Republic of Indonesia

HumasUPNVJ - UPN Veteran Jakarta (UPNVJ) received a visit from the DPD Group at the MPR, Friday (10/12/21) in the Meeting Room, UPNVJ Faculty of Law (FH) Building. This visit was carried out in the context of discussions with a number of UPNVJ experts regarding the main points of state policy and the Discourse on the 5th Amendment to the 1945 Constitution of the Republic of Indonesia.

"First, why do we need the direction of the state? Because we hope that the country's development will not experience discontinuity due to changes in leadership. This tendency can be seen at the national level, such as political promises that are inconsistent with the direction of the state. So it needs the direction of the state. Second, the arrangement of the MPR's authority, where the task is only to inaugurate and dismiss the president. Third, the arrangement of the authority of the DPD. The DPD and DPR pay the same, the position is the same, but the authority is different. Sometimes we DPD here have a moral burden. We do not participate in deciding the law. Because of that we need to make arrangements related to article 22 paragraph E. Fourth, arrangement of presidential principles," said the Head of the DPD Group in the MPR, Drs. Tamsil Linrung.

In discussions with these experts, there are seven studies that will be studied, namely the Principles of State Policy, Arrangement of the Authority of the DPR, Arrangement of the Authority of the DPD, Arrangement of the Presidential System, Arrangement of Judicial Powers, Arrangement of the Legal System and Arrangement of the Socialization System (4 Pillars).

In this case, Dr. Erna Hernawati, Ak, CPMA, CA, CGOP The Chancellor of UPNVJ welcomes this special opportunity and will support it by providing input from UPNVJ legal experts.

“I really have a special opportunity. I heard that what the DPD is trying to do is of course a priority where friends in the Faculty of Law provide input which is a strategic matter. We from UPNVJ are of course very supportive, where UPNVJ has experts, hopefully this will be an opportunity for us to provide suggestions and solutions for these DPD ladies," said the Chancellor.

In line with the Chancellor, Dr. Abdul Halim, M.Ag, Dean of the Faculty of Law UPNVJ also said that he would fully support the idea by conducting a critical study.

"We have to be active where as a State Defense campus, FH UPNVJ has to be proactive about changes. So we feel in line with DPD's wishes. We have lecturers who can carry out research and studies for academic papers. Whatever the product of the law it must be responsive, so this responsive mechanism must be lived in accordance with the pillars of democracy. We do not support the DPD, but we support the idea, so we will conduct a critical study," added Dr. Abdul Halim.

In the initial discussion, Prof. Bambang Waluyo, who is a lecturer and professor at UPNVJ, said that he agrees that changes create gaps between state administrations.

"In my opinion, the seven proposals are still the latest. Second, in relation to the 5th amendment, I also agree because of what Mr. Tamsil has explained earlier. With the MPR not being able to set the GBHN, it is like "sak karepe dewe", so there needs to be a GBHN so that it doesn't there are interests that are not juridical, economic etc. For article 22, I see that it is also lacking. If members of the DPD and DPR are deficient, but don't go too far, maybe for ideological, ecological, economic reasons. Then for the 5th amendment it is necessary, for example from institutional side. Perhaps it is necessary to strengthen the role of public relations so that it is not inferior to the DPR. Because in fact, the DPD lost to the DPR, from the constitution it also lost, for the number also maybe the amount can be adjusted according to the number of residents.
