Beni Harefa: KPK Must Be Strengthened Not Weakened

HumasUPNVJ - The Corruption Eradication Commission (KPK) must be strengthened, not weakened. This was conveyed by Beniharmoni Harefa, a lecturer at the Faculty of Law, Jakarta Veterans National Development University in a National Discussion held by BEM FH UPN Veterans Jakarta (4/6/2021). Present as a speaker Faisal Djabbar (Corruption Eradication Commission employee), Dr. Beniharmoni Harefa, SH, LL.M . (Lecturer of FH UPN Veteran Jakarta), Feri Amsari, SH, MH, LL.M. (Lecturer from Faculty of Law Andalas University & Director of Pusako), another speaker.

After the revision of the KPK Law, a number of things have become important highlights. Several important points in Law Number 19 of 2019 concerning Amendments to Law Number 30 of 2002 concerning the Corruption Eradication Commission, namely the issue of wiretapping, searches and confiscations which must be permitted by the Supervisory Board (Dewas). Through the decision of the Constitutional Court Number 70/PUU-XVII/2019, wiretapping, searches and confiscations no longer require the permission of the Dewas, but only notification is sufficient.

In addition, other issues, namely the termination of the investigation and the termination of the prosecution. In the previous law, the KPK did not recognize the termination of investigations and prosecutions, in the revised law, the KPK was given the authority to stop investigations and stop prosecution.

Another issue after the revision of the 2019 KPK Law was the transfer of the status of KPK employees, which has been widely questioned lately. Referring to the Constitutional Court's decision Number 70/PUU-XVII/2019, in the consideration of the Constitutional Court judges, it emphasized that the transfer of KPK employee status to ASN must not harm the rights of KPK employees for any reason.

What should be revised immediately is the Material Law on Corruption Eradication, namely Law 31/1999 jo 20/2001, including adjusting the Corruption Law with the United Nations Convention Against Corruption (UNCAC) which has been ratified by Law No. 7/2006. Revision of the Corruption Law and ratification of the Asset Confiscation Bill far more urgent than the revision of the KPK Law itself.

In the future, Beni Harefa said, it would be best if the Corruption Eradication and Corruption Eradication were handled by the Corruption Eradication Committee alone, to prevent judicial mafia, so that the police and prosecutors would also focus, handling corruption would be handed over to the Corruption Eradication Commission (KPK).
