Law Students Win Bachelor Degrees, Discuss Reformulation of Articles of Law on Management of National Resources for National Defense

HumasUPNVJ - Jakarta January 5 2023, UPN Veterans Jakarta (UPNVJ) Faculty of Law student, Aditama Candra Kusuma who is a member of the Reserve Component earned a Bachelor of Laws degree by researching the problems of termination of employment that occurred during the Reserve Component selection process.

The dissemination took place in the Dissemination Meeting Room on the 3rd floor of the Yos Sudarso Building which was chaired directly by the Chairperson of the Session who was also the Head of the Legal Study Program for the Taupiqqurrahman, SH, M.Kn. In this presentation Aditama said that the writing was motivated by the existence of cases of layoffs that occurred to workers when workers took part in selection and basic military training for Reserve Components, as well as the existence of legal loopholes in Law Number 23 of 2019 concerning Management of National Resources for National Defense which can be used as a momentum for employers to lay off workers during the selection of Reserve Components.

This study aims to investigate criminal sanctions for employers who lay off workers during the selection of Reserve Components, as well as examine the ideal arrangements for employers to lay off workers participating in the selection of reserve components in the future. In his research, the authors provide a form of recommendation for article reform, namely the addition of an article element which states "undergoing selection" because in Article 37 paragraph (1) and Article 78 paragraph (1) of the PSDNPN Law there is no legal protection for workers participating in the Reserve Component selection.

"I hope that this research can be used as an academic study or meaningful participation in improving old legal products so that in the future there will be no layoffs for workers who wish to register as a reserve component," Aditama said when interviewed after the trial took place.
